Announcement of the Ministry of Commerce

In order to support enterprises in the Comprehensive Bonded Zone to carry out high-tech, high-value added maintenance businesses that meet environmental protection requirements, in accordance with the Several Opinions of the State Council on Promoting the Innovative Development of Processing Trade (GF [2016] No. 4) and the Several Opinions of the State Council on Promoting the High level and High quality Development of the Comprehensive Bonded Zone (GF [2019] No. 3), relevant matters are hereby announced as follows:
1、 Enterprises in the Comprehensive Bonded Zone (hereinafter referred to as enterprises in the Zone) can carry out the maintenance business of aerospace, ships, rail transit, engineering machinery, CNC machine tools, communication equipment, precision electronics and other products (see the annex for the first batch of maintenance products).
Except for laws, administrative regulations, regulations of the State Council or provisions authorized by relevant departments of the State Council in accordance with laws and administrative regulations, enterprises in the zone shall not carry out the maintenance business of goods prohibited from import and export by the State.
2、 Enterprises in the zone can carry out global maintenance business from overseas or outside the special supervision area of domestic customs (hereinafter referred to as “outside the domestic zone”). The repaired goods shall be transported overseas or overseas according to their sources. Enterprises in the zone shall not carry out disassembly, scrapping and other businesses through maintenance.
3、 For enterprises in the zone to apply for maintenance business, the management committee of the bonded zone (or the administrative agency dispatched by the local government) shall jointly study and determine with the local commerce, customs and other departments, and formulate a regulatory plan. The relevant plans and the list of enterprises shall be submitted to the provincial commerce, customs directly under the Central Government and other departments for the record.
4、 To carry out maintenance business, enterprises in the zone shall formulate practical maintenance operation specifications, safety regulations and pollution prevention schemes. The maintenance business shall comply with the relevant industrial management specifications and technical standards, and fulfill the obligations of quality assurance, safe production, up to standard discharge, soil and groundwater pollution prevention and control according to law.
5、 In principle, all leftover materials, old parts, damaged parts, etc. generated or replaced in the process of entry maintenance shall be transported out of the country; If it is really impossible to transport them out of the country, they shall not be sold domestically and shall be destroyed in accordance with relevant regulations. Among them, solid waste shall be disposed of by the enterprise in accordance with the relevant provisions on environmental management of solid waste. If the leftover materials, old parts and broken parts produced or replaced in the maintenance process cannot be disposed according to the regulations within the period specified in the supervision plan, the bonded maintenance business shall be terminated.
6、 The enterprises in the area shall, in accordance with the relevant provisions of the State, establish a standing book for the management of solid waste, and report the type, quantity, flow direction, storage, utilization and disposal of the solid waste generated according to law and regulations, and report through the national solid waste management information system.
7、 The Administrative Committee of the Comprehensive Bonded Area (or the administrative organization dispatched by the local government) shall earnestly perform its main responsibilities, regularly organize the assessment of the maintenance business of enterprises in the area, urge enterprises to timely dispose of leftover materials, old parts, damaged parts, etc. generated or replaced in the maintenance process, and deal with the enterprises in violation of the regulations. The maintenance business of each comprehensive bonded area shall be summarized and reported to the Ministry of Commerce, the Ministry of Ecological Environment and the General Administration of Customs by the provincial competent commercial department every year.
8、 This announcement shall come into force as of the date of promulgation. Bonded maintenance business that has been carried out before the announcement can continue to be carried out according to the original product maintenance scope.
